All members confirm they own the copyright to their songs, and or, they have received written permission from a joint copyright holder/s.  Copyrights to all songs will remain the property of the copyright holder/s, all rights reserved by the copyright holder/s.

All profits from the album will be divided equally and paid to each members PayPal account (preferred method) or Members bank account (members to pay any Bank transfer fees if applicable) every six months, for a maximum of three years from the official launch date, administered by Denis Ahmet (Denis) from routenote.com.  Once the album goes live any member's song will be on the album for life. As indicated by signature (below) the signer:
1.    Is indicating full acceptance of responsibility for the outcome of his/her participation in the album project entitled "The AMP Volume Two" and thereby frees Bandamp.com, it's membership, administration, agents, ownership, volunteers including Denis Ahmet of any liability for damages that might occur as a result of the signer's participation in the album project entitled "The Amp Volume Two".
2.     Releases BandAmp.com, its membership, agents, volunteers, administration and ownership of any responsibility in administration of the project or the album entitled "The Amp Volume Two".

Getting better all the time...

We may have to change it a little, in that MountStRobbie does not want the particular nominated song  on the album, I only found out a few days ago, but having said that we can replace the song, as indeed if any other members decide to opt out, there will be room for more songs, so long as it fits on a CD. You could just change the agreement to say something like 'all partisipants' or' all members/artists', that way we can genrealise the contract for future use. Or just leave it. 

Once we are happy with the agreement I'll PM it to all partispating members on the album for the final OK

I've a feeling we may not be able to get hold of some of the members on the album. There are some songs that were nominated and I believe the members are not even aware that their song has been nominated. I'll worry about that when it comes to it, it's not a problem we have thousands of songs and I'm sure many who would want to partisipate.

Yeah , I see . That´s the kind of solution I wished to find all the time .

Catty , respect to the patient explanations about the responsibilities of "bandamp" , administration (denis) and the participiants . It helped all of us (esp. me ) to understand how the contract must have been built and to warn against judical traps and clearing up my blueeyes.  

Denis , I´m glad you didn´t withdraw the work and found back to a great teamwork with Catty on the finish line .

Every post of us showed all the different expectations and intentions in the project . I can say I´m happy to see you guys happy now .

There´s only one more question about the "runtime" of VOL. 2 : Will it be released forever (lifetime) or is there any timelimit ? This point I didn´t understand yet .

Yip , that´s fine to me . Tnx, cat . 3 yrs is ok . An overstock you can never control . But doesn´t matter .

Forgive my ignorance, I'm not clear how the agreement stands after the three years, should we perhaps have something to state what happens, or is this already covered in the agreement.

There�s only one more question about the "runtime" of VOL. 2 : Will it be released forever (lifetime) or is there any timelimit ? This point I didn�t understand yet .

Thanks, ULI. Also, I see what you mean about the time limit. So far, it appears we have agreed that the limit for administration will be three years; however, this doesn't address what happens to the continued production of copies of the CD, or what happens to any overstock. Denis may have the answer to that.

Forgive my ignorance, I'm not clear how the agreement stands after the three years, should we perhaps have something to state what happens, or is this already convered in the agreement.
Good question. Upon consideration of TK's post above, I have an idea: Maybe, in two and a half years you could have an option to advise the artists/participants that the deadline for the termination of the agreement is approaching and ask them if they want to continue to pursue administration of the album, and if so, have them sign a new agreement. That way you might be able to pursue this thing 3 years at a time (the next agreement would be for three years, artists/participants could decide who they want to administer the album for three years from the date of the signature of the new agreement). Possibly, the participants might elect not to pursue further administration of the album and thus would let the project die (it seems there would have to be some coordination of termination of all operations that incur a cost, i.e., continued publishing of the CD, etc). On the other hand, Denis, I wonder if it is possible or desirable among the participants to plan now to simply end all operations at 3 years. Again, it would appear that you would have to plan for discontinuance of all operations that incur a cost ahead of the actual termination of the agreement. Let's say you plan to discontinue all publishing of the album at two and a half years (six months ahead of termination of the agreement), with the idea that you might stand a better chance of selling off all stock, and thereby recouping costs of production before the project ends - however, correct me if I'm wrong, but I think I heard that Volume One didn't sell very well, so in anticipation that Volume Two might follow suit, then maybe everyone could plan now to let the project die at three years regardless (I say that based on some of the artists/participants have already expressed that they are not expecting a profit). So, to summarize, here are the options that I'm just visualizing now:

(Option One) - Pursue this project three years at a time - make an addition to the current agreement that all participants will have the option to sign a new agreement in two and a half years, in preparation for the end of this current agreement.

(Option Two) - all artists/participants decide now to proactively cease all operations in three years, and the current agreement amended to acknowledge that plan.

Option Two is clean cut. As the album is for life, if after the three years, any artist/participant not wishing to renew the agreement, their portion of monies to be given to bandAMP for maintenance or prizes. Although I believe in order for this to happen a treasurer needs to be appointed.

Or the agreement could just be annual - As it is unlikely the album will make substantial profit due to no marketing etc, I think most members will offer the money to bandAMP

Option two, the way I see it, would mean there would be no more income to manage, as all operations have ceased.

You've got a point about the annual agreement - that might be more practical - however, it does mean you or somebody would have to really stay on top of it and start this whole process (of contacting the participants, presenting an agreement, having them review it and getting their signatures) again in 6 months or 9 months or whatever - just as long as it's done before the existing agreement runs out. That's a lot of maintenence, it seems to me.
